Maryland caps the resale package at the association's actual cost, up to $330.17 as of October 1, 2026, plus an inspection where required (up to $100 for a condo, $50 for an HOA) and up to $100 for rush delivery.

Settlement fees

Recording a release costs $50 under state law ($10 plus a $40 surcharge). Settlement, deed preparation and payoff fees are not regulated and vary by company; the defaults are typical figures.

Property tax

Estimated from the Montgomery County rate: 1.1521% of the sale price plus $566.06 in fixed charges for a house. Your bill may differ: it is based on the assessed value, not the price, and owner credits lower it.

Maryland law defaults to an even split unless the contract says otherwise, or the buyer is a first-time Maryland homebuyer.

The seller then pays the transfer and recordation taxes by default, and the state transfer tax is halved.

Montgomery County bills in July for the tax year July 1 to June 30, so taxes are paid ahead. A principal residence pays in two halves, due September 30 and December 31, with no service charge; other homes pay the full year by September 30. This estimate uses the two-payment schedule, with each half paid by its due date, unless you check that you paid the full year at once. It charges the buyer for the day of settlement.

Taxes to know about

When a seller who does not live in Maryland sells Maryland property that was not their principal residence, the court clerk collects income tax at settlement: 8.75% for an individual, 8.25% for a business entity, on the net paid to the seller. It is a prepayment credited on the Maryland return, not a cost, and a seller can apply ahead of closing (Form MW506AE) to have it reduced to the tax on the actual gain.

If the seller is a foreign person for U.S. tax purposes, federal law (FIRPTA) generally has the buyer withhold 15% of the sale price at settlement, with lower or no withholding in some cases where the buyer will live in the home. Ask your settlement company early.

Commissions

The listing commission and any buyer agent commission you agree to pay, each a percentage of the sale price. Both are negotiable.

Transfer and recordation taxes

The seller's share of the state and county taxes on the sale, from the same rates as the closing cost calculators. In Virginia that is the grantor's tax and the two regional fees; in Maryland it depends on how the contract splits the taxes.

Payoffs

What you owe on your mortgage and any second loan or home equity line on the day of settlement. Ask your lender for a payoff statement for the exact figure.

Property tax proration

Taxes are split by the day at settlement. If you have already paid past the closing date, the buyer pays you back; if a bill is still unpaid, you owe your share. The result shows which, and for how many days.

Settlement costs

The settlement or attorney fee, deed preparation, and releasing and recording the release of each loan. The defaults are typical figures; your settlement company sets the real ones.

Taxes on the sale
